TERMS AND CONDITIONS

Once the deposit and/or corresponding payments (Cash, check, money order or other form of payment) are made for any of our products/services, it constitutes your unconditional acceptance of all the terms and conditions that are set forth in this brochure on those mentioned above.

DOCUMENTS: U.S. citizens require a valid passport. Other nationalities, please contact their respective embassies. A Viajar Tours is not responsible for the lack of a visa by passengers who require special visas to enter other countries. Every passport must be valid for up to six months after the date of return from the pilgrimage or trip. It is the passenger's responsibility to check their passport and visa, as well as their expiration dates.

REGISTRATION AND DEPOSITS: An initial deposit of $500.00 per person is required at the time of registration, as well as completion of the registration form. The passenger agrees to send a copy of his/her valid passport. Registrations are processed in the order received by A Viajar Tours. The balance of the payment must be paid 60 days before departure. Late check-ins (60 days prior to departure) must be attached to full payment of the trip departure. A Viajar Tours reserves the right to cancel reservations that are not paid in full 60 days prior to departure, and to charge the fees/penalties indicated below. $35.00 will be charged for all checks returned by our bank. 

REFUNDS AND INDIVIDUAL CANCELLATION FEES: All cancellations must be received by A Viajar Tours in writing via our email aviajartours.avt@gmail.com or by contacting any of our associates. And will process refunds, EXCLUDING AIR TICKET, minus a cancellation change according to the following schedule: 1) $150.00 if canceled at least 90 to 31 days prior to the tour's departure date. 2) NO REFUNDS for cancellations made 30 days or less prior to the departure date of the tour. 3) The initial deposit is NOT refundable. A Viajar Tours strongly recommends the Passenger Travel Protection Program (see below "THE PASSENGER TRAVEL PROTECTION PROGRAM") 

TOUR OPERATION AND CANCELLATION: A Viajar Tours expressly reserves the right to cancel all or any part of the tour or make any changes to the itinerary, for any reason it deems necessary for comfort, convenience or safety of tour participants. In the event of any alteration to the itinerary, every effort will be made to replace the altered activity or accommodations with a comparable replacement. A Viajar Tours is not responsible for, and hereby disclaims any liability, for any losses, expenses, damages and inconveniences caused as a result of any tour cancellations or changes made to the itinerary. In addition, A Viajar Tours is not responsible for any additional costs or bills related to insurance and/or cancellations of airfare and other arrangements that have not been made through A Viajar Tours.

CANCELLATION FEES BEYOND THE CONTROL OF A Viajar Tours: A Viajar Tours declines any responsibility for any expenses or losses incurred due to the cancellation or alteration of the resulting tour, but limited to: cancellations due to travel reasons or warnings issued by the Department of State or some other relevant authority, acts of war, terrorism, acts of God, natural disasters or any other circumstance beyond the control of A Viajar Tours. A Viajar Tours is not responsible for any non-recoverable amounts disbursed to carriers or other service providers on its behalf.

HEALTH: Most foreign countries do not conform to U.S. Disability law. A Viajar Tours cannot provide individual assistance for each pilgrim, nor can we board buses or other transportation vehicles. Participants who need such assistance must be accompanied by a qualified person at all times and own expense. Although A Viajar Tours does not accept any responsibility to provide access to all the facilities included in the trip. A Viajar Tours assumes no responsibility for the pilgrim's inability to participate fully in the tour, nor does A Viajar Tours provide any refund for not participating in some parts of the tour. If you do not wish to participate in any activity during the tour please inform the designated person of the trip and acknowledge that A Viajar Tours will not refund activity not accepted for any reason.

AIR TRANSPORTATION: All airfare is roundtrip economy class and is non-refundable unless otherwise specified. Any cancellation, itinerary changes, or failure to confirm your space will be subject to penalties and/or fees charged by the airline at the time of ticket sale. Airline ticket, airline and airline schedules are subject to change without notice! A VIAJAR TOURS IS NOT RESPONSIBLE FOR CHANGES IN FLIGHT SCHEDULES, APPLIED Signature: Page of 2 of 4 BY THE AIRLINES, NOR ANY OTHER TYPE OF CANCELLATION, OVERBOOKING OF TICKETS OR ACTIVITY INCURRED BY THE AIRLINES.! Passengers arranging their own flights are responsible for meeting the group at the first hotel on the group's itinerary. A Viajar Tours is not responsible for changes in the airlines' itinerary, which cause last minute changes to the planned itineraries.

DEVIATIONS: Deviations from the group's itinerary are not possible. If you wish to make your own arrangements with the airlines and purchase only the ground portion of the pilgrimage, please contact a representative of A Viajar Tours to get the correct price. AIRLINE, FREQUENT FLYER AND MEAL ORDER 

SEAT REQUESTS: Seats are on a group basis only. A Viajar Tours advises that you call the airline two weeks before takeoff to have frequent flyer miles and special meal ordering. A Viajar Tours is not responsible if the airline does not grant frequent flyer miles or if the airline does not give you the option to choose seats. 

BAGGAGE: Baggage is at risk all the time. A Viajar Tours strongly suggests that you bring only one bag with a weight not exceeding 40 pounds and that your bag be checked in at the time of check-in at the airport. Carry-on bags are subject to the capacity of the group, which will be notified if it will be possible to be included. The passenger is responsible for his luggage throughout the pilgrimage, whether it is to board planes, buses, or other types of transportation. The passenger is responsible for paying for extra weight or overweight suitcases. 

ACCOMMODATION AND MEALS: Based on double rooms with private bathrooms. Triple room consists of a double room plus an extra bed, and confirmation is based on availability. The meals included are mentioned in each program separately. 

EXCURSIONS: Excursions take place in a private coach, the entrance fees that are included in the program will be mentioned in the initial itinerary. 

PRICES: Prices are based on exchange rates, fares are applicable at the time of change and the minimum number of passengers by payment indicated in the brochure and is therefore subject to change. 

NOT INCLUDED: Passports and visas, meals not mentioned, drinks with meals, extras beyond the standard menu, excess baggage, fuel surcharges, laundry or any other items not included. TAXES AND 

GRATUITIES: Hotel fees and taxes and indirect taxes are not included (except when specifically indicated in the pilgrimage brochure). Gratuities for guides, drivers and porters are included in the case indicated in the pilgrimage brochure. If this is not the case and if you want to do so, it will be at the request of the guides or drivers and the discretion of the pilgrim. 

DISCLAIMER: A Viajar Tours expressly disclaims all liability for personal injury, property damage, loss of luggage, accidents, delays or irregularities, any claim for special or consequential damages or any loss that may be occasioned by the acts and/or omissions, whether negligent, wrongful or wrongful of any airline, hotel/motel or other accommodation operator, railroad operator, bus operator, public transportation, sea carrier, local tour company, tour operator, tour guide or spiritual director, any employee on their behalf, or for any other entity or individual who is not under the direct supervision and control of A Viajar Tours when involved in the transportation of passengers or in the execution of Tour arrangements, or otherwise in connection with it. In addition, A Viajar Tours disclaims any liability for damages, losses or expenses incurred, or caused by inconvenience due to delays or changes in the schedule due to predetermined values on hotel or airline reservations, illness, weather, strikes, quarantines, acts of terrorism, construction, war, force majeure or other events that are beyond the control of A Viajar Tours. Likewise, you are exempt from any possibility of statements, actions or inactions of any intermediary agent such as group administrators, spiritual directors or the tour leader, travel agents or other intermediaries involved with the sales, promotion or operation of the A Viajar Tours tour. In addition, to the fullest extent permitted by law, A Viajar Tours exempts from any liability for damages or injuries or other losses suffered or incurred as a result of the pilgrim's negligence. For information regarding possible damage to destinations, we recommend that you contact the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov and click on "Travel Warnings. For medical information, we recommend contacting the Center for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. Group Administrators, Spiritual Leaders, and Tour Leaders hereby expressly disclaim any responsibility for the acts and/or omissions of any of the above entities and/or individuals not directly under their supervision or control. Please note that the liability of carriers, as well as hotel and accommodation suppliers is limited by law, for this reason, you may consider purchasing the Passenger Travel Protection Plan and/or additional insurance to protect you against loss or injury suffered as a result of their acts and/or omissions. In no event shall the liability of A Viajar Tours exceed the amounts paid by you for participation in the tour and subject to the provisions and cancellation charges as expressed in this brochure. In the event that the tour leader and/or spiritual director, who were named in this way in the brochure and itinerary, do not travel with the group, A Viajar Tours reserves the right to appoint substitutes of their choice for each person. A Viajar Tours is not responsible for any incorrect or erroneous quotations contained in this brochure or in any documentation included, the content of these may be changed at any time without prior notice and at the discretion of A Viajar Tours. HAZARDOUS MATERIAL WARNING: U.S. Federal Law prohibits the transportation of hazardous materials on airplanes, in your luggage, or on your person. Rape may result in imprisonment of five (5) years and penalties of $250,000.00 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gas, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive material. Examples: paint, lighter fluid, pyrotechnic devices, tear gas, oxygen tanks, and radioactive pharmaceuticals. There are exceptions for small amounts (up to 70 ounces total) of medicinal and toiletries in your luggage and certain smoking material on your person. For more information, check out the prohibited items on the TSA website: www.tsa.gov ANTI-DISCRIMINATION POLICY: A Viajar Tours! does not discriminate on the basis of race, religion, creed, color, national origin, ancestry, physical or mental disability, medical condition, marital status, sex, age, sexual orientation, or the status of a Vietnam veteran or other veteran in the provision of its tour or pilgrimage services.

PHOTOGRAPHY: The photos shown in the brochure are only examples of the places to visit on certain tours and unless specifically mentioned in the brochure itinerary, no implication is made that these places will be visited or seen on this tour. A Viajar Tours reserves the rights to take photographs for promotional purposes. If any participant who prefers their images not to be used, they are asked to notify A Viajar Tours in writing prior to departure.

SEPARATE INSURANCE (PROTECTION): It is the sole responsibility of the passenger to obtain the correct and comprehensive travel insurance to cover the trip, his family and/or travel companion(s) for the duration of the trip. Travel insurance should cover the following possibilities but should not be limited to the same: cancellation or modification of the trip, emergency evacuation expenses, medical expenses, repatriation expenses, damage, theft, loss of luggage, money or goods. A Viajar Tours, including its representatives, employees and agents, shall not be liable for expenses or losses suffered by the passenger because of the foregoing possibilities and for causes not specifically contemplated. 

CLAIMS AND COMPLAINTS – LIMITED TIME: In cases of non-compliance or defects in the execution of the contracted services, the consumer is obliged to notify A Viajar Tours in writing as soon as possible. A Viajar Tours will examine, as soon as possible and in good faith, the complaints submitted and will make every effort to achieve a prompt and equitable resolution of the same amicably. The statute of limitations for actions to file claims arising from this contract will be thirty (30) days. 

SEVERABILITY: If a provision of the terms and conditions is illegal, invalid, or unenforceable for any reason, that provision is deemed severable from these terms and conditions and that provision shall not affect the validity or enforceability of the remaining provisions.

LEGAL NOTE: The statements herein and the contract between its participants and A Viajar Tours are made and entered into Hopkins County, Texas. It is hereby agreed and stipulated that any controversy or claim arising out of, or relating in any way to, these terms and conditions of the brochure, or any other information relating in any way to the trip, or the trip itself, for which an amicable agreement cannot be reached, shall be litigated either in the state court and by Hopkins County, Texas, or in the United States District Court for the Central District of Texas and is registered under the laws of the State of Texas. NOTE: A Viajar Tours is a Registered Travel Seller in the State of Texas. 

ENTIRE CONTRACT: The passengers warrants that no promises or inducements have been offered other than the terms and conditions set forth in this contract and that this contract is executed without reliance on promises or representations outside of this contract. Modification, termination or renunciation of this contract is not valid if the same is not in writing and signed by the passenger and A Viajar Tours.
